SUBJECT OF CONTRACT.- The subject of this contract is the provision of real estate promotion and marketing services aimed at real estate agencies and/or real estate agents, henceforth THE AGENCY, who have access to all the services offered by the company EXPO REAL ESTATE MARKETING S.L., henceforth ZODDAK, in Avenida Ricardo Soriano 66 – Marbella. These marketing and promotion services consist of online and offline activities that are listed below:
- Client access during opening hours from Monday to Friday from 10:00 am to 6:00 pm and Saturdays from 10:00 am to 2:00 pm. EXPO COSTA DEL SOL reserves the right to open on Sundays as well as local celebrations and/or national holidays.
- Access to the online platform with all the latest information of more than 150 promotions located on the Costa del Sol in order to inform customers about prices, availability, etc.
- Once the trial period is over and the first payment is confirmed, you will receive an E-book in printed and electronic format (PDF) updated every two months and customized with your agency’s logo.
- Support by our team with all the information on each promotion needed by your client to help with the successful search and purchasing decision.
- Personalized monthly training by promoters for all agents. These trainings take place in the real estate exhibition centre and the agency will be notified in advance of the dates on which such training will be held.
- Invitation to special events such as coaching, golf tournaments, etc.
CONDITION OF PAYMENT.- Invoices will be issued each month in advance and paid by direct debit order, bank transfer or any other means that ZODDAK makes available to THE AGENCY in the five days following the date of issue of the invoice. The non-payment of one month entitles ZODDAK to terminate the contract.
TERMINATION OF THE CONTRACT.- THE AGENCY can request the termination of the contract to ZODDAK at any time, without any commitment of permanence or cancellation charges, provided that the communication is made at least five days before the established billing period.
CONFIDENTIALITY AND DATA PROTECTION.- ZODDAK expressly undertakes to observe and enforce the necessary confidentiality with respect to the promotion and information of the clients of THE AGENCY and its agents in accordance with the General Regulations for the Protection of Data (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016.
RESPONSIBILITY.- THE AGENCY is responsible for its client and the information that is provided. ZODDAK under no circumstances will accept any liability arising from a possible dispute between these parties. ZODDAK acts merely as exhibitor of the information provided by the promoters, without prejudice to any actions brought by to publicize the exhibition among agencies and to enable the relationship with them.
DISPUTES.- Any settlement of disputes arising from this contract, submit jurisdiction and competence to the Courts of Marbella.
